User Definitions
Users of the Site are categorized into two groups:

Offeror Users: These users create and upload content, including advertisements and profiles.

Recipient Users: These users access the content posted by Offeror Users and can contact them through the provided contact information.
By continuing to use the Site, you consent to the Terms of Use as they stand at the time of your visit. If you disagree with any part of these terms, please exit the Site immediately.

Personal Data and Privacy
Your personal data is handled according to our Privacy Policy, which also outlines our use of cookies and similar technologies. We only collect the minimum necessary personal data required to provide our services and comply with legal obligations.

To become an Offeror User, you must accept these Terms of Use, including the Acceptable Use Policy and the Summary and Guidelines, prior to creating an advertisement or profile.

Platform Operations

NITEHOOKUP operates the Site as a platform provider. We do not exercise prior editorial control over the content uploaded by Offeror Users. However, we reserve the right to remove any advertisements or profiles that:

• Violate these Terms of Use
• Contain harmful software or material
• Are deemed unlawful or prejudicial
• Are reported for abuse or harassment

  Users can report inappropriate content using the “Report Abuse” feature on the Site. We will investigate all reports and take appropriate action, which may include removing the content in question.

User Obligations
The services offered on the Site are intended for adults. By using these services, you affirm that you are 18 years or older. Misrepresenting your age or attempting to bypass age verification measures is a violation of these Terms.

Both Offeror and Recipient Users are fully responsible for their conduct on the Site and any interactions with other Users. We do not guarantee the accuracy of any advertisements or the outcome of any negotiations between Users.

Limitation of Liability
We do not accept liability for:

• Loss or damage beyond our reasonable control
• Interruptions or unavailability of the Site
• Indirect losses, such as loss of profits or data
• Any claims arising from events outside our control
  In cases where liability is applicable, it is limited to the greater of the amounts paid by the User in the previous 12 months or specified monetary caps.

Paid Services for Offeror Users
By publishing an advertisement, Offeror Users authorize us to promote it for greater visibility. Users must ensure their content complies with applicable laws. We reserve the right to remove any advertisement that violates these Terms without offering refunds.

Refunds Policy
Generally, we do not provide refunds for Paid Services. However, in exceptional circumstances, we may offer credit for future services at our discretion. We reserve the right to block User profiles if a financial institution requests a refund related to a transaction until the issue is resolved.

Acceptable Use Policy
Users must not use the Site to:

• Transmit offensive, discriminatory, or illegal content
• Engage in misleading conduct or scams
• Publish content that violates privacy or intellectual property rights
  Offeror Users are responsible for ensuring that they have consent to publish any personal data included in their advertisements.

Summary and Guidelines
Key points to remember:

• Inappropriate content, including pornography, hate speech, or material involving minors, is strictly prohibited.
• Users must confirm they have the legal right to publish any content they submit.
• Advertisements may be posted in a maximum of three different cities, but not repeated in the same city during the same timeframe.
  Hyperlinks in advertisements or profiles are not allowed.
  We will operate the service to maximize effectiveness while adhering to these guidelines. If you encounter content that violates our policies, please report it to us at privacy@nitehookup.in.

Governing Law
These Terms of Use are governed by the laws of the Republic of Cyprus and are subject to the exclusive jurisdiction of Cypriot courts.
